Acro + Dance Retreat v.1 — Ao Nang, Krabi, Thailand

By completing your deposit or paying in full for the Acro + Dance Retreat v.1, you confirm that you have read, understood, and agreed to these Terms and Conditions in full. These terms form a binding agreement between you (the participant) and the retreat organiser, Zera, trading as Zera | Circus Arts.
01.

Registration and Payment

Your spot at the retreat is only secured upon receipt of a non-refundable deposit of USD $500. Submission of a deposit constitutes acceptance of these Terms and Conditions.

Two payment options are available:

  • Pay in full: Payment of the full retreat fee upfront entitles you to a USD $100 discount off the total price. Full payment must be arranged directly with the organiser.
  • Payment plan: After the $500 deposit, 50% of the remaining balance is due by July 15, 2026. The final balance is due by September 1, 2026.

A 5-day grace period applies to all payment deadlines. Failure to complete payments by the deadline (including the grace period) may result in the loss of your spot and forfeiture of all deposits and payments made.

All prices are listed in USD. The organiser is not responsible for currency conversion fees or banking charges incurred by the participant.

Cancellation by Participant

Cancellation before August 15, 2026: You will receive a refund of 50% of all payments made, including the deposit. The remaining 50% is retained by the organiser to cover administrative costs, venue commitments, and losses incurred.

Cancellation on or after August 15, 2026: All payments are non-refundable. No refund will be issued for any portion of payments made, regardless of reason.

All cancellation requests must be submitted in writing via email to zera.circus@gmail.com. Cancellations are effective from the date the written request is received and confirmed by the organiser.

Payment default: If a participant fails to complete any scheduled payment within the 5-day grace period, their spot will be forfeited and all payments made to that point, including the deposit, will be retained by the organiser as compensation for the lost spot. The organiser is under no obligation to hold the spot or offer alternative arrangements.

The organiser strongly recommends that all participants obtain comprehensive travel insurance that covers trip cancellation, medical emergencies, and unforeseen circumstances prior to making any payment.

Transfer of Spot

If you are unable to attend, you may request to transfer your spot to another eligible person. You are solely responsible for finding a suitable replacement participant.

All transfers must be submitted in writing and are subject to approval by the organiser. The organiser reserves the right to decline a transfer request at their discretion. The replacement participant must meet any requirements set by the organiser and must agree to these Terms and Conditions.

Any financial arrangements between you and the replacement participant are entirely your own responsibility. The organiser will not facilitate or be liable for any such arrangements.

Cancellation or Modification by the Organiser

The organiser reserves the right to cancel, postpone, or modify the retreat in the following circumstances:

  • Insufficient participant numbers (minimum number required to run the retreat)
  • Force majeure events including but not limited to natural disasters, pandemics, government travel restrictions, war, civil unrest, or any event beyond the organiser's reasonable control
  • Illness or emergency affecting the lead instructor or key personnel
  • Venue unavailability or circumstances rendering the retreat unsafe or impractical
  • Any other circumstances the organiser reasonably deems necessary

In the event of cancellation by the organiser: Participants will receive a full refund of all payments made, including the deposit. The organiser's liability is strictly limited to the return of monies paid and does not extend to travel costs, accommodation booked independently, visa fees, insurance premiums, or any other expenses incurred by the participant.

In the event of postponement: Participants will be offered the option to transfer their booking to the rescheduled date or receive a full refund of all payments made.

In the event of modification: If changes are made to the programme, schedule, venue, or guest teachers, no refunds will be issued unless the modification is deemed material by the organiser. The organiser will endeavour to notify participants of any significant changes as soon as possible.

The organiser will not be held liable for any indirect or consequential losses arising from a cancellation, postponement, or modification of the retreat, including but not limited to flight costs, visa fees, lost earnings, or accommodation booked independently.

Participant Requirements and Conduct

By registering, you confirm that you are in good physical and mental health and are capable of participating in movement-based activities including acrobatics, dance, and mobility training. If you have any medical conditions, injuries, or concerns, it is your responsibility to consult a medical professional prior to attending and to inform the organiser before the retreat begins.

The organiser reserves the right to remove any participant from the retreat without refund if their conduct is deemed harmful, disruptive, or unsafe to themselves or others, or if they have misrepresented their health or fitness in order to attend.

Participants are expected to treat all other guests, instructors, and venue staff with respect. The organiser has zero tolerance for harassment, discrimination, or behaviour that compromises the safety or wellbeing of others.

06.

Liability and Assumption of Risk

Participation in physical activities including acrobatics, dance, handstands, and mobility training carries an inherent risk of injury. By registering, you acknowledge and accept this risk voluntarily.

The organiser, instructors, guest teachers, and any affiliated personnel shall not be held liable for any injury, illness, loss, damage, or death arising from participation in retreat activities, whether caused by negligence or otherwise, to the fullest extent permitted by applicable law.

The organiser shall not be liable for any loss, theft, or damage to personal property during the retreat.

The organiser shall not be responsible for any medical costs, emergency evacuation costs, or associated expenses incurred by participants during or as a result of the retreat. Participants are strongly advised to hold comprehensive travel and medical insurance before attending.

Nothing in these Terms and Conditions shall limit liability for death or personal injury caused by the organiser's proven gross negligence or wilful misconduct.

07.

Health, Safety and Travel

It is the participant's sole responsibility to ensure they hold a valid passport, appropriate visa, and any required travel documentation for entry into Thailand. The organiser accepts no liability for participants who are unable to travel due to visa, documentation, or immigration issues.

International flights to and from Thailand are not included in the retreat fee and are the participant's sole responsibility to arrange. The organiser strongly recommends purchasing comprehensive travel insurance that covers flights, cancellation, medical emergencies, and personal liability before making any payment.

Airport transfer: The organiser will arrange a scheduled group shuttle transfer from the airport to the retreat venue in Ao Nang, Krabi, at no additional cost to participants. Details of the scheduled shuttle time and meeting point will be provided in the welcome pack. Participants who miss the scheduled shuttle due to late arrival, flight delays, or any other reason are responsible for arranging and funding their own transportation to the venue. The organiser accepts no liability for additional transport costs, delays, or missed time at the retreat resulting from a participant missing the scheduled transfer.

The organiser reserves the right to require a participant to withdraw from activities at any time if they believe the participant's health or safety is at risk.

08.

Photography and Media

Photo and video content may be captured during the retreat for personal and promotional use by the organiser. By attending, you consent to your likeness being captured and used in social media, marketing materials, and future retreat promotions.

If you do not wish to appear in promotional content, you must notify the organiser in writing prior to the retreat. The organiser will make reasonable efforts to accommodate your request but cannot guarantee exclusion from all group photographs or footage.

Participants will receive a selection of photo and video content captured during the retreat for their personal use. This content is not to be used for commercial purposes without written permission from the organiser.

09.

Privacy

Personal information collected during registration will be used solely for the purpose of organising and communicating about the retreat. Your information will not be sold or shared with third parties except where required by law or necessary for the running of the retreat (e.g. venue staff, emergency contacts).

10.

Governing Law and Disputes

These Terms and Conditions are governed by the laws of the State of [YOUR STATE], United States. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of [YOUR STATE], United States. The organiser acknowledges that the retreat takes place in Thailand and that participants may be subject to local laws and regulations during their stay, for which the organiser accepts no responsibility.

In the event of a dispute, the parties agree to first attempt resolution through good faith communication before pursuing legal action.

11.

Amendments

The organiser reserves the right to update these Terms and Conditions at any time. Participants will be notified of any material changes. Continued participation following notification of changes constitutes acceptance of the updated terms.
